| Q.
I have been injured in an accident, when should
I contact a lawyer? A.
It is important that you contact a lawyer as soon
as possible after an accident occurs. Depending
upon the type of accident and the persons involved,
there are prescribed times within which notice
must be given and there are limitation periods
within which legal proceedings must be commenced.
For instance, in the case of the Disrepair of
a Roadway or a slippery sidewalk, written notice
must be given to the Municipality within ten days
failing which there is the risk that an injured
person would lose their entitlement to compensation.
Speaking with a lawyer after an accident occurs
helps prevent loss of a claim for damages caused
by an elapsed time period.
Q.
I have been involved in a car accident. Does "no
fault" insurance mean that I can't sue the
driver responsible for the accident?
A.
No. While under the current automobile insurance
scheme the right to sue has been restricted, if
you have been seriously injured in a motor vehicle
accident, you are still entitled to take legal
action against the individuals responsible for
the accident.
Q. I've been injured in an accident
but I can't afford to retain a lawyer, how can
I get the compensation to which I am entitled?
A.
At Graves·Richard·Harris LLP we
understand that injured victims are unlikely to
be able to afford legal fees at a time when they
are recovering from an injury. For this reason
we are often able to defer our legal fees until
the litigation has been settled, in most cases
there will be no fee if we are unsuccessful in
recovering compensation for our client. In addition,
at Graves·Richard·Harris LLP, your
initial consultation is always free.
Q. I've been involved in an
accident, but I am unsure if I am able to commence
legal proceedings, what should I do?
A.
At Graves·Richard·Harris LLP your
initial consultation is always free, and there
is no obligation on you to start legal proceedings.
